Agreement to our Legal Terms

We are RS Online Shopping, doing business as RS Online (‘Company’, ‘we’, ‘us’, or ‘our’)

We operate the website http://www.rsonline.com.na (the ‘Site’, the ‘website’) as well as any other related app, link, products, and services that refer to these legal terms (the ‘Legal Terms’) (collectively, the ‘website, ‘Services’)

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of any entity (‘you’), and RS Online Shopping, concerning your access to and use of the Services. You agree that by accessing the Site and its Services, you have read, understood, and agreed to be bound by all of these Legal Terms.

Supplemental terms and conditions or documents that may be posted on the site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms at any time and for any reason. We will alert you about any changes by updating the ‘Last Updated’ date of these Legal Terms, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Legal Terms to stay informed of updates. You will be subject to and will be deemed to have been made aware of and to have accepted, the changes in any revised Legal Terms by your continued use of the Site after the date such revised Legal Terms are posted. You are also responsible to seek clarification from us should you not understand any of the Terms and Conditions posted.

This site and its services are intended for users who are 18 (eighteen) years and older and of full legal capacity. If you are under the age of 18 (eighteen) you must have the permission of, and be directly supervised by, a parent or guardian, to use the site. Such parent/guardian therefore accepts these Terms & Conditions, is legally bound by them, and is liable and responsible for you and your obligation under these Legal Terms.

The information provided when using the site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the site from other locations do so on their won initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the site or any portion thereof.

You may not access or use the site and its services for any purpose other than that for which we have made it available. The site, products and services included, may not be used in connection with any commercial endeavours except those that are specifically endorsed or approved by us.

User Registration

You must register to use the site. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our discretion, that such username is inappropriate, obscene, or otherwise objectionable.

Username and Password shall be used for personal use only and not be disclosed to any 3rd party.

You agree that once you correct username and password related to your account have been entered, irrespective of whether the use is unauthorized or fraudulent, you will be liable for payment of such order. You must notify RS Online immediately upon becoming aware of, or reasonably suspect ANY unauthorized access or use of your username and password.

Products

RS Online Shopping is an Online Marketplace Website and only provides the platform to facilitate transactions between Third-Party Vendors/Sellers and RSOL Customers. We are neither the buyer not the seller of these goods unless otherwise specified. The site relies on 3rd parties and Vendors to supply stock inventory and availability. We make every effort to display as accurately as possible the colours, features, specifications, and details of the products on the site. However, we do not guarantee that the colours, features, specifications and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colours and details of the products. All products are subject to availability, and we cannot guarantee that items will be in stock. We reserve the right to discontinue any products at any time for any reason. Prices for products are subject to change. We bear no liability for information as supplied and any dispute to be resolved with Vendors directly.

Any product requiring permits or certification (such as televisions and TV Licenses amongst others) will be subject to the condition that we obtain such valid permit and/or certificates. If we do not receive this information or if it cannot be validated, you will not be able to check out.

Purchases and Payment

We accept the following forms of payment.

  • Visa
  • Mastercard
  • PayToday

We are committed to providing secure electronic payment facilities and all encryption technology applied accordingly to ensure the safekeeping of your information.

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the site. You further agree to promptly update account and payment information, including email address and mobile telephone number, payment method, and payment card expiration date, so that we can complete your transaction and contact you as needed. You warrant that you are fully authorized to provide and use the details and cards/facilities for payment for the account provided for purposes of paying the goods.

You also warrant that there are sufficient available funds for such purchases and all costs incurred with the services provided by the site. You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees, and you authorize us to charge your chosen payment provider for any such amounts upon placing your order.

Not all Third Parties are registered VAT Vendors. Therefore, Value Added Tax / VAT is included in the purchase price only for those items supplied/sold by registered VAT vendors.

If your order is subject to recurring charges, then you consent to our charging your payment method on a recurring basis without requiring your prior approval for each charge, until such time as you cancel the applicable order. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment. All payments shall be in Namibian Dollars.

Wishlist items do not constitute a completed order.

We will send you an email confirmation of your order and payment. Standard delivery options cater to allow such payments to reflect and orders to be processed for delivery.

We reserve the right to refuse any order placed through the site. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors unless a Legal Agreement has been implemented between such entities and RS Online Shopping.

Delivery Policy

RS Online Shopping reserves the right to select delivery agents.

You will see the applicable delivery charges in your cart when you check out.

RS Online will deliver your goods to you as soon as possible, but no later than 30 days of receipt of your payment.

We will notify you if we are unable to deliver your goods.

Once goods are delivered to your nominated delivery address, we are no longer responsible for your goods.

We operate fully under the liquor legislation of Namibia and therefore:

Alcohol and tobacco products, and/or any products restricted to sale to persons of legal age and capacity, are not for sale to persons under the age of 18. Upon the ordering of such products, a legal person must be available at the nominated delivery address to receive orders and such person remains liable for the accessibility of such products.

Return/Refund Policy

Please review our Return Policy on the site prior to making any purchases. This Policy, by reference, forms part of the Terms and Conditions.

User Generated Contributions

The Site does not offer users to submit or post content.

You and RSOL agree that we may access, store, process and use any information and personal data that you provide following the terms of the Privacy Policy and your choices.

By submitting suggestions or other feedback regarding the site, you agree that we can use and share such feedback for any purpose without compensation to you.

Guidelines for Product Reviews

We may provide you areas on the site to leave reviews or ratings. When posting a review, you must comply with the following criteria:

  • You should have firsthand experience with the product or entity (RSOL) being reviewed.
  • Your reviews should not contain offensive profanity, or abusive, racist, offensive, or hateful language.
  • Your reviews should not contain discriminatory references based on religion, race, gender, nationality, age, marital status, sexual orientation, or disability.
  • Your reviews should not contain references to illegal activity.
  • You should not be affiliated with competitors if posting negative reviews.
  • You should not make/draw any conclusions as to the legality of conduct.
  • You may not post any false or misleading statements.
  • You may not organize a campaign encouraging others to post reviews, whether positive or negative
  • You are reviewing PRODUCTS and SERVICES ONLY. Not persons nor entities other than RSOL.

We may accept, reject, or remove reviews in our sole discretion. We have absolutely no obligation to screen reviews or to delete reviews, even if anyone considers reviews objectionable or inaccurate. Reviews are not endorsed by us, and do not necessarily represent our opinions or the views of any of our affiliates or partners.  We do not assume liability for any claims, liabilities, or losses resulting from any review. By posting a review, you hereby grant us a perpetual, non-exclusive, worldwide, royalty-free, fully paid, assignable and sublicensable right and license to produce, modify, translate, transmit by any means, display, perform, and/or distribute all content relating to review.

The site may contain links (or you may be sent via the site or App) to other websites (‘Third-Party Websites’) as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software, and other content or items belonging to or originating from third parties (‘Third-Party Content’). Such Third-Party Websites and Third-Party Content are not investigated, monitored, or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any Third-Party Websites accessed through our website or any Third-Party Content posted on, available through, or installed from the website, including the content, accuracy offensiveness, opinions, reliability, privacy practices, or other policies of or contained in the Third-Party Websites or the Third-Party Content. We allow advertisers to display their advertisements and other information in certain areas of the site, such as sidebar advertisements or banner advertisements. We simply provide the space to place such advertisements and we have no other relationship with advertisers.

We reserve the right, but not the obligation to:

  • Monitor the Website for violations of these Terms and Conditions.
  • Take appropriate legal action against anyone who, in our sole discretion, violates the law or these legal Terms, including without limitation, reporting such users to law enforcement authorities.
  • In our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof.
  • In our sole discretion and without limitation, notice, or liability, to remove from the site or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems.

Please be advised the services offered by this website are hosted in Namibia. These Legal Terms shall be governed by and defined following the laws of Namibia. RS Online Shopping and you irrevocably consent that the courts of Namibia shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Legal Terms.

Dispute Resolution

Any disputes arising from products and services offered through the site are explicitly to be resolved between Third Parties and Consumers individually. RSOL is not to be involved in these disputes although we reserve the right to become involved in an attempt to resolve such disputes.

There may be information on the website that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the website at any time, without prior notice.

We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control.
